Terms and condition for hiring a "Brussels or Antwerp Segwaytour" and or a Segway
Introduction
The Brussels or Antwerp Segwaytour is a public event that takes place from May 1st to September 26th 2010 and from May 1st to September 25th 2011 - except on Mondays and Tuesdays. Tickets must be bought online or on the day of the tour for specific requests. Pre-sold tickets that are not collected on the planned tour day are considered sold and can therefore not be exchanged or reimbursed.
In the case of pre-sold tickets, any natural or legal person in whose name the booking is made will be considered as the only person liable for the booking and for its payment.
Should a tour be cancelled by the organizer and except in cases of acts of God (rain, ?), the request for reimbursement must be accompanied by the proof of payment of the ticket and sent by recorded mail within seven days to the address below:

These terms and conditions are valid for the contractual relations between the lessor and the lessee, with the two parties accepting them without reserve. These terms and conditions prevail over any terms written in any other document, except in the case of a prior written formal dispensation.
- This document lays down the rules of collaboration between the organizer Major Dreams SPRL, located Rue Charles Quint 96 in Brussels 1000 and recorded under the company n° 0894.188.758 and the user of Segway. The reservation is made in accordance with the conditions stipulated below, which the user expressly acknowledges having read and accepted by the very fact of using the Segway.
- The price for hiring the Segway, including the guarantee, must be paid prior to using the Segway. If not, the organizer is entitled to refuse the use thereof.
- Anyone wishing to use the Segway must learn how to use it under the guidance of an instructor from Major Dreams (also referred to as 'the organizer').
- The user undertakes to use the helmet supplied by the organiser and to abide strictly by the conditions for using the Segway and the safety instructions which will be given during training and which are displayed at the locations where the Segway can be hired. The user undertakes to follow the route for which the reservation was made. He/she undertakes to follow the provisions of the Belgian Highway Code applicable to the type of vehicle being hired (in this case, Article 432.15.2 - bicycles and motorcycles).
The Segway is for personal use only - the user may not lend it or rent it out to any other person without the prior written consent of the organizer. The use of Segways by persons under 16 years of age is forbidden.
- The user declares that he/she is able to use the Segway and has no medical contra-indication.
- The user acknowledges that the Segway is in perfect operating condition and undertakes to use it with the utmost care and diligence and to return it (with the accessories provided for its use: helmet) at the end of the hire period in the condition in which he/she found it at the start. He/she shall return it to the organizer at the time and place stated when he/she hired it. Any delay in returning the Segway will be charged for at ?38 per hour or part thereof. Any damage to and/or losses regarding the Segway and/or the accessories provided for its use shall be paid for in full by the user. Such charges shall be invoiced or may be deducted directly from the guarantee deposit or debited from his/her debit card. The amounts for damage caused to the machines are as follows:
Broken steering: 1.390 ? - Damaged battery: 750 ? - Broken mudguard: 490 ? - Broken wheel: 1.200 ? - Total write-off: 7.000 ?.
The user will be asked to provide proof of identity when he/she hires the vehicle. The organizer reserves the right to cancel or shorten the tour, if the instructor considers that the behavior of the user is likely to affect the safety of the machines or other people.
- The Organizer, its personnel and its subcontractors shall not be liable for any damage to, or loss of property, or injury or death or any other damage sustained by the user or third parties, during or after, due to, or in connection with, or in consequence of the performance or non-performance of the service covered under this Agreement unless caused by willful misconduct.
The organizer shall incur no liability for any consequence of a breakdown or failure on the part of the SEGWAY.
- This agreement shall be governed by the Belgian law. Any dispute shall be brought before the Courts of Brussels.
